Conducting a fair workplace investigation can be a legal minefield for an employer and a challenging situation for employees. There are a host of issues one must be clear about:

Do the Parties have a right to cross examine?
Does a party have a right to legal representation?
Should the investigation issue findings of fact, or give recommendations?

Mediation

Mediation is as important tool in conflict resolution in and outside the workplace in Ireland. It is most effective when used early on in a conflict and can be a very cost-effective and time saving process for all parties involved.

What is Mediation?

Mediation is a confidential, facilitative, and voluntary process in which parties to a dispute, with the assistance of a mediator, attempt to reach a mutually acceptable agreement to resolve the dispute.

The fact that the process is confidential makes it especially suitable for disputes in which the parties do not wish to have their dispute aired in public. Nothing said at Mediation or in related documents especially produced for Mediation can be referred to in litigation if the case does not settle.

Contact us and our mediators qualified under the Mii (Mediators’ Institute of Ireland) will assist you in finding ways to create a lasting settlement.
